GENERAL TERMS – CREWED BOAT CHARTER AGREEMENT

First

The owner is the proprietor or operator of the vessel subject to this agreement, model llaüt Medvolt M7, 7.30 meters in length, equipped with a 10 kW electric motor and 20 kW batteries.

Vessel registration number:  6ª BA-1-137-23

Maximum authorized capacity: SEVEN  passengers plus skipper.

Second

The OWNER shall provide a skipper holding the required qualifications and experience for navigation.

The vessel may be operated exclusively by the designated skipper.

Third

The charter shall commence upon boarding and shall end at the agreed time. The contract shall not be considered terminated until the vessel has been returned to the company’s personnel.

Any extension must be expressly authorized.

Fourth

The vessel and crew are insured by an insurance company covering accidents occurring on board.

The OWNER shall not be liable for injuries or damages resulting from diving, swimming, or other activities not expressly contracted.

The CHARTERER assumes responsibility for proper use of snorkeling equipment, paddle boards and sea scooters.

In case of loss or damage due to misuse, the OWNER may retain an amount to cover replacement or repair.

Fifth

The price and services shall be those established in the contractual document.

Only services expressly indicated are included.

Food, alcoholic beverages and any other unspecified items are excluded.

 

Seventh

The CHARTERER agrees to follow all maritime safety and environmental protection instructions provided by the skipper.

Eighth

Smoking, throwing waste into the sea, cooking, and transporting animals on board are prohibited.

Ninth

In case of negligence, damage to the vessel, breach of law or contractual clauses, the OWNER may immediately terminate the contract, retaining paid amounts as compensation.

Tenth

Adverse weather conditions, such as cloudy days, shall not constitute grounds for cancellation unless safety is compromised.

If safety reasons prevent navigation, an alternative date shall be offered or the amount refunded.

Eleventh

 

Minors must always be accompanied or supervised by an adult. The crew is not responsible for their custody.

Cancel conditions

Cancellation Policy:

  1. Reservation and Deposit: When booking an activity through our application more than 7 days in advance of the scheduled date, the user is required to pay a deposit of 99€ to secure their reservation. The user must pay the remaining balance 7 days prior to the activity.

  2. Cancellation with more than 7 days' notice: If the user cancels their reservation at least 7 days before the scheduled date of the activity, they will receive a full refund of the €99 deposit.

  3. Cancellation between 7 days and 48 hours' notice: If the user cancels their reservation between 7 days and 48 hours before the scheduled date of the activity, they will forfeit 50% of the amount paid (total price of the activity).

  4. Cancellation with less than 48 hours' notice: If the user cancels their reservation with less than 48 hours' notice, no additional refunds will be provided.

  5. Changes to the Reservation: Changes to the reservation are subject to availability and may be subject to additional charges.

In the event that the charter cannot be conducted due to adverse weather conditions, the charter company must issue a voucher to the customer, allowing them to enjoy the activity within the next 365 calendar days.
